La Rivista Diritto dello Sport è una rivista scientifica open access con revisione anonima peer review che ospita articoli di livello nazionale e internazionale nelle seguenti lingue: Italiano, Inglese, Francese e Spagnolo; per la pubblicazione degli articoli non è richiesto all’Autore alcun contributo di tipo economico (free of APC – Article Processing Charges). La rivista ha una periodicità semestrale.

Ai sensi dell’art. 10 del Regolamento per la Classificazione delle riviste nelle aree non bibliometriche (approvato dall’ANVUR con Delibera del Consiglio Direttivo n. 42 del 20 febbraio 2019), la rivista Diritto dello sport si conforma alle vigenti linee-guida delineate dal “Committee on Publication Ethics” (COPE).

In particolare, tutti gli organi della Rivista (Coordinatore responsabile, Comitato di Direzione e Redazione, Segreteria di Redazione, Comitato Scientifico), i Redattori ospiti, i Revisori, gli Autori e l’Editore condividono i seguenti principi etici.

Regole etiche in tema di valutazione e pubblicazione degli articoli

1. La Rivista si impegna a pubblicare gli articoli sottoposti a revisione anonima tra pari (a singolo cieco – single blind o a doppio cieco – double blind peer review) fatta da almeno un esperto della materia (Revisore) non appartenente alle strutture editoriali e possibilmente è esterno al Comitato Scientifico facendo salva la facoltà di una selezione preliminare da parte del Comitato di Direzione e Redazione in ordine ai contributi da sottoporre a referaggio ai sensi dart. 9, comma 1, Reg. ANVUR.

2. Il Comitato di Direzione e Redazione si impegna a rispettare le normative in materia violazione del copyright, plagio e di diffamazione.

3. Il Comitato di Direzione e Redazione effettua verifica riguardo all’originalità dei contributi ricevuti e qualora fosse rilevata una situazione di plagio, l’autore del contributo verrà informato con un avvertimento. Se a seguito dell’avvertimento l’autore già avvertito trasmettesse alla Rivista un diverso contributo anch’esso non connotato da originalità, il Comitato di Redazione e Direzione potrà decidere di escludere per il futuro la pubblicazione di scritti del medesimo autore, senza ulteriori motivazioni o verifiche del materiale trasmesso. A tal fine la Rivista tiene un elenco degli autori che hanno trasmesso dei contributi non contraddistinti da originalità.

4. I criteri per la valutazione dei contributi saranno basati in via esclusiva sul valore scientifico e sul contenuto degli stessi, senza discriminazioni di sesso, razza, genere, religione, origine etnica, cittadinanza, orientamento sessuale, identità di genere, età e orientamento politico degli autori. Qualora venisse rilevata una discriminazione nelle schede di valutazione pervenute dai Revisore, il Comitato di Direzione e Redazione procederà all’esclusione del Revisore dall’elenco dei valutatori.

Riservatezza e Correttezza.

5. Nelle fasi antecedenti e successive alla valutazione, gli organi della Rivista (Coordinatore, Comitato di Direzione e Redazione e Segreteria di Redazione) si impegnano a non rivelare a terzi informazioni relative al contenuto dell’articolo, ai tempi di referaggio e a non usare i contenuti degli articoli non pubblicati per ricerche proprie, senza l’espresso consenso scritto dell’autore. Fermi restando l’anonimato dell’autore e del Revisore, informazioni non strettamente connesse alla valutazione del contributo potranno essere fornite ai revisori e all’editore, o stampatore esclusivamente dopo aver raccolto il consenso dell’autore.

6. La Rivista adotta il procedimento di revisione tra pari assicurandosi che i contributi trasmessi restino strettamente confidenziali durante il processo di valutazione. Al fine di ricevere una valutazione adeguata dell’articolo che ne consigli o meno la pubblicazione del contributo, il Coordinatore, coadiuvato dal Comitato di Direzione e Redazione, individua il revisore sulla base della competenza e della fiducia improntando la decisione al principio di autonomia e di assenza di conflitti di interesse.

Doveri degli Autori dei contributi in corso di pubblicazione

7. Tutti gli Autori sono consapevoli del fatto che i loro lavori sono pubblicati in open access sulla piattaforma online dirittodellosport.eu, con licenza Creative Commons Attribution (CC BY). Gli autori mantengono il copyright dei loro articoli senza restrizioni. Gli autori concederanno quindi all’editore il diritto di prima pubblicazione e altri diritti di pubblicazione non esclusivi

8. Rispetto delle Linee guida. L’Autore garantisce che l’articolo sottoposto a valutazione sia inedito, scientificamente originale e non sottoposto contemporaneamente ad altre riviste, volumi o periodici, salvo espresso consenso del Comitato di Direzione e Redazione. L’articolo potrà essere pubblicato di seguito in altri periodici o volumi, previo consenso Comitato di Direzione e Redazione. In tal caso dovrà essere espressamente inserito il riferimento alla precedente pubblicazione su Diritto dello Sport.

L’Autore si impegna a rispettare le Linee guida e le Norme redazionali indicate per la pubblicazione sulla Rivista.

9. Paternità dell’opera. La paternità del contributo deve risultare con chiarezza e nel caso di opere con più di un autore la parte redatta da ciascun autore deve essere chiaramente evidenziata. La paternità dell’opera deve essere limitata a coloro che hanno dato un contributo significativo all’ideazione, scrittura e interpretazione dei contenuti della ricerca. L’Autore principale (che interagisce con i Curatori) deve garantire che tutti i Coautori siano correttamente inclusi e abbiano supervisionato e approvato la versione finale dell’opera e acconsentano alla pubblicazione. Eventuali ulteriori contributi alla ricerca presentata nell’articolo potranno essere menzionati dagli Autori in una nota finale dell’articolo, unitamente a una nota di ringraziamento. I nomi degli autori saranno elencati nell’articolo nello stesso ordine in cui gli autori sono elencati nella sottomissione.
10. Originalità. Gli autori garantiscono contributi scientifici originali, assicurando che l’articolo inviato non sia mai stato pubblicato altrove o da altri. I manoscritti proposti non devono essere stati pubblicati come materiale protetto da copyright in altre riviste o volumi.

11. Conflitto di interessi. L’autore non si deve trovare in una posizione di conflitto d’interesse in grado di condizionare i risultati della sua ricerca, le tesi sostenute, o le interpretazioni proposte. L’intervento di supporto di eventuali soggetti finanziatori o il progetto da cui deriva la ricerca devono essere evidenziati in maniera chiara all’interno del contributo.

12. Errori nelle pubblicazioni. Qualora a seguito della pubblicazione on-line, l’autore rilevi inesattezze, errori o refusi nel suo contributo, deve informare tempestivamente la Rivista, impegnandosi a collaborare attivamente con gli organi della Rivista al fine della buona e immediata riuscita della procedura di correzione. In questa eventualità, la Rivista si riserva la possibilità di sospendere l’accesso on-line del contributo sino al completamento delle modifiche.

13. Controversie. Chiunque riscontri una violazione delle suddette regole può sollevare la questione presso la Direzione della Rivista. Il Comitato di Redazione, con il contributo del Comitato Scientifico, risponderà alla richiesta entro 45 giorni. Ove necessario, il Comitato di Redazione e il Comitato Scientifico possono avvalersi del parere di soggetti esterni particolarmente qualificati. Le decisioni della Redazione e del Comitato Scientifico saranno sempre motivate. Qualsiasi ritiro di una pubblicazione sarà accompagnato da una motivazione completa e pubblica dell’azione intrapresa.

Processo di revisione

14. L’accettazione degli articoli per la pubblicazione è sottoposta al vaglio del Coordinatore e del Comitato di Redazione ed eventualmente di uno o più Redattori ospiti, che potranno suggerite all’Autore delle migliorie da apportare all’articolo prima che lo stesso venga inviato ad un Revisore per la valutazione. La tempistica media per la pubblicazione dei contributi è di circa 90 giorni dalla ricezione della loro proposta. Almeno 4 settimane sono assegnate alla fase della revisione.

15. Il Coordinatore, con il supporto del Comitato di Redazione ed eventualmente con l’aiuto del Consiglio Scientifico o di uno o più Redattori ospiti, individua il Revisore secondo i criteri sopra indicati all’art. 6 e gli trasmette il contributo (tramite la Segreteria di redazione) assegnandogli un termine per l’esecuzione dell’incarico. A discrezione del Comitato di Direzione e Redazione può essere individuato più di un Revisore. Al fine di garantire l’anonimato durante il procedimento di revisione, l’Autore non ha la possibilità di suggerire un Revisore.
16. Il Coordinatore di Direzione, con l’ausilio della Segreteria di Redazione potrà domandare all’autore le correzioni e le integrazioni che il Referee ha segnalato necessarie durante la procedura anonima di revisione. Il Comitato di Direzione e Redazione potrà portare a conoscenza dell’autore la valutazione, in forma anonima, espressa dal Revisore. L’autore potrà esprimere obiezioni riguardanti la valutazione del Revisore, sulle quali deciderà Comitato di Direzione e Redazione.
17. Il Revisore, oltre ai rilievi di dettaglio sul contributo analizzato, indicherà un giudizio finale sul contributo che potrà consistere in: a) pubblicabile senza correzioni, b) pubblicabile con correzioni, c) pubblicabile con correzioni sostanziali, d) non pubblicabile. Qualora l’esito fosse “pubblicabile con correzioni” sarà cura del Comitato di Direzione e Redazione, verificare se l’autore ha apportato le correzioni segnalate dal Revisore; qualora l’esito fosse “pubblicabile con correzioni sostanziali”, il contributo corretto e/o integrato dall’autore sarà trasmesso al Revisore per una nuova valutazione.
18. Al fine di garantire l’omogeneità di pubblicazione della Rivista, il Comitato di Direzione e Redazione si riserva di procedere a modifiche meramente editoriali del contributo dopo la prima correzione della bozza.
19. Il Comitato di Direzione e Redazione si riserva di pubblicare gli articoli con la calendarizzazione che riterrà più opportuna per la composizione scientifica ed editoriale dei fascicoli.

Doveri etici dei Valutatori

20. Il lavoro dei Revisori è volontario e gratuito.

21. Rispetto delle tempistiche. Il Revisore si impegna a inviare un responso entro 45 giorni dall’invio del contributo. Il revisore che non si senta adeguatamente qualificato per la revisione del contributo, o che abbia un impedimento temporaneo allo svolgimento della valutazione deve comunicarlo immediatamente al Comitato di Direzione e Redazione.

22. Conflitto di interessi. I valutatori sono tenuti a non accettare articoli per i quali emerga un conflitto di interessi dovuto a precedenti specifici rapporti di collaborazione o concorrenza con l’autore (di per sé ignoto, ma comunque individuato per deduzione) e/o a connessioni con gli enti o le istituzioni collegate al contributo.

23. Rigore della revisione.

La valutazione dei contributi deve essere improntata a criteri di oggettività e correttezza escludendo ogni valutazione di carattere personale e/o ideologica. Le osservazioni del Revisore devono essere di natura strettamente tecnica e analiticamente riportate sul modulo di valutazione inviato dalla Redazione al momento della richiesta di referaggio. In particolare, ogni dichiarazione, osservazione o argomentazione riportata deve preferibilmente essere accompagnata da una corrispondente citazione e/o documentazione, ovvero adeguatamente illustrata.

24. Nel caso di esito negativo della valutazione, il revisore è invitato ad indicare gli estremi bibliografici essenziali trascurati dall’Autore. Laddove riscontri eventuali somiglianze, o sovrapposizioni del contributo ricevuto con altre opere a lui note il Revisore è tenuto a segnalarle immediatamente alla Comitato di Direzione e Redazione.

25. Riservatezza. Il revisore non può in alcun modo diffondere il contributo ricevuto, ovvero farne oggetto di discussione con soggetti non autorizzati dalla Comitato di Direzione e Redazione. Il contenuto dello scritto e le informazioni riservate ottenute durante la procedura di revisione non devono essere utilizzati dal Referee a proprio vantaggio scientifico o personale. Tutte le informazioni e indicazioni ottenute durante il processo di revisione devono essere considerate riservate e non possono essere usate per altri scopi.

Diritto dello Sport is an Open Access scholarly journal featuring a peer review process. It welcomes national and international articles in Italian, English, French, and Spanish. Authors are not obligated to make any financial contributions for the publication of their articles, as the journal is free of Article Processing Charges (APC). The publication schedule is biannual.

Following the art. 10 of the Regulations for the Classification of Journals in Non-Bibliometric Areas (approved by ANVUR with Resolution of the board of Directors no. 42 of 20 February 2019), the journal Diritto dello sport complies with the current guidelines outlined by the “Committee on Publication Ethics” (COPE).

All the committee of the journal (Editor in chief, Editorial board, Editorial Secretariat, Scientific board), the Guest editors, the Referees, the Authors, and the Publisher respect the following ethical principles.

Ethical rules on the evaluation and publication of articles.

1. The Journal undertakes to publish the articles submitted to one anonymous review (single blind peer review or double blind peer review) made by one or more subject experts (referee) not belonging to the Editorial board, and possibly not belonging to the Scientific board. The Editorial board maintain the right of a preliminary selection to select the contributions which have to be referred in accordance with art. 9, paragraph 1, Reg. ANVUR.
2. The Editorial board undertakes to comply with the regulations on copyright, plagiarism and defamation.
3. The Editorial board checks on the originality of the articles received and if a situation of plagiarism is detected, the author of the article will receive a warning. If after the warning the author will submit another not original writing, the Editorial board may decide to exclude him from future publications, without further reasons or verification of the material transmitted. For this scope, the Journal keeps a list of authors who have submitted contributions not distinguished by originality.
4. The criteria for the evaluation of the articles will be based exclusively on the scientific value and their contents, without discrimination of sex, race, gender, religion, ethnic origin, citizenship, sexual orientation, gender identity, age and political orientation of the authors. If discrimination is found in the evaluation forms received from the referees, the Editorial board will proceed to exclude the referee from the list of referees.

Confidentiality and Correctness

5. In the phases before and after the evaluation, the bodies of the Journal (Editor in chief, Editorial board and Editorial Secretariat) undertake not to disclose to third parties information relating to the content of the articles, the timing of the evaluation process, and not to use the contents of the unpublished articles for their own research, without the express written consent of the authors. Without prejudice to the anonymity of the author and the referee, information not strictly related to the evaluation of the contribution may be provided to the referees and the publisher, or the printer only after receiving the consent of the author.
6. The Journal adopts the peer review process to ensure that submitted articles remain strictly confidential during the evaluation process. In order to receive a qualified evaluation of the article that advises or not the publication of the contribution, the Editor in chief, assisted by the Editorial board, identifies the referee on the basis of competence and trust, basing his decision on the principle of autonomy and absence of conflicts of interest.

Duties of the Authors of the contributions being published.

7. All Authors are aware that their works are released in open access mode on the online platform dirittodellosport.eu, under the Creative Commons Attribution (CC BY). The authors retain the copyright of their papers without restrictions. Authors will then grant the publisher the right of first publication, and other non-exclusive publishing rights.
8. Compliance with Guidelines. The authors guarantees that the articles submitted for evaluation are unpublished, scientifically original and not submitted at the same time to other journals, volumes or periodicals, unless expressly consented to the Editorial board. The article can be published in other periodicals or volumes, subject with previous consent of the Editorial board. In this case, a reference to the previous publication in Diritto dello Sport must be expressly inserted.

The Author undertakes to comply with the Guidelines and Editorial Rules indicated for publication in the Journal.

9. Authorship. The authorship of the contribution must be clear and in the case of articles with more than one author, the part written by each author must be clearly highlighted. The authorship of the work must be limited to those who have made a significant contribution to the conception, writing and interpretation of research content. The main Author (who interacts with the Editors) must guarantee that all Co-authors are properly included and have supervised and approved the final version of the work and they agree to the publication. Any additional contributors to the research presented in the article may be mentioned by the Authors in a final note of the article, along with a note of thanks. Author names will be listed in the article in the same order that authors are listed in the submission.
10. Originality and plagiarism. Authors shall guarantee original scientific contributions, ensuring that the submitted article has never been published elsewhere or by others. The proposed manuscripts must not have been published as copyrighted material in other journals or volume.
11. Conflict of interest. The authors must not be in a position of conflict of interest that can potentially influences the results of their research, the theses supported, or the interpretations proposed. The support of any funding or subjects, and the project from which the research derives must be clearly highlighted within the article.
12. Errors in the published articles. If after the online publication the author detects inaccuracies, errors or typos in his contribution, he must promptly inform the Journal, and collaborate actively with the committees of the Journal in order to ensure the good and immediate success of the correction procedure. In this case, the Journal reserves the right to suspend online access to the contribution until the changes are completed.
13. In case of disputes. Anyone who finds violations of the above rules can raise the issue with the Editors of the Journal. The Editors, with the contribution of the Scientific Board, will respond to the request within 45 days. Where necessary, the Editors and the Scientific Board may avail themselves of the opinion of specially qualified external individuals. The decisions of the Editors and the Scientific Board will always be motivated. Any retraction of a publication will be accompanied by a complete and public motivation of the action taken.

Reviewing process

14. The acceptance of the articles for publication is subject to the scrutiny of the Editor in chief and the Editorial board, with the help of one or more Guest editors if necessary, who may suggest to the Author improvements to the article before to send it to a Referee for the review. Scientific contributions are typically published within an average timeframe of approximately 90 days from the date of proposal receipt. The review phase alone is allocated a minimum of 4 weeks.

15. The Editor in chief, with the support of the Editorial board, and with the help of the Scientific board and or one or more Guest editors if necessary, identifies the Referee according to the criteria indicated above in art. 6 and sends him the article (with the help of the Editorial secretariat), assigning him/her a deadline for the execution of the review. The Editorial board can decide to identify more than one Referee. In order to guarantee the secret during the review process, the Author does not have the possibility to suggest a Referee.
16. The Editor in chief, with the help of the Editorial Secretariat, may ask the author for the corrections and additions that the referee has reported necessary during the anonymous revision procedure. The Editorial board may bring to the attention of the author the evaluation, anonymously, expressed by the referee. The author may express objections regarding the evaluation of the referee, on which he will decide on the Management and Editorial Committee.
17. The referee, in addition to the detailed observations on the analysed contribution, will indicate a final judgment on the article which may consist in: a) publishable without corrections, b) publishable with corrections, c) publishable with substantial corrections, d) not publishable. If the result is “publishable with corrections” it will be the responsibility of the Editorial board to verify whether the author has made the corrections indicated by the referee; if the result is “publishable with substantial corrections”, the contribution corrected and/or integrated by the author will be sent to the referee for a new evaluation.
18. To ensure the homogeneity of the publications on the Journal, the Editorial board reserves the right to proceed with purely editorial changes to the articles after the first correction of the draft.
19. The Editorial board have the right to publish the articles with the scheduling that it deems most appropriate for the scientific and editorial composition of the issues.

Ethical duties of Referees

20. 20. Referees’ work is voluntary and free.
    21. Compliance with time schedule. The referee undertakes to send a response within 45 days of sending the articles. The referee who does not feel properly qualified for the revision of the articles, or who has a temporary impediment to carrying out the evaluation must immediately notify the Editorial board.
    22. Conflict of interest and disclosure. Referees are required not to accept articles if a conflict of interest emerges due to previous specific relationships of collaboration or competition with the authors (who are unknown, but in any case, can be identified by deduction) or if a connection emerges with the bodies or the institutions related to the articles. Stringency of the peer-review.
    23. The evaluation of contributions must be based on criteria of objectivity and correctness, excluding any personal and ideological evaluation. The comments of the referee must be strictly technical and analytically reported on the evaluation form sent by the Editorial Secretariat at the time of the request for referencing. Each given statement, observation or argument must preferably be accompanied by a corresponding quotation and documentation, or adequately illustrated.
    24. In case of a negative outcome of the evaluation, the referee is invited to indicate the essential bibliographic details neglected by the Author. Where the referee finds any similarities or overlaps of the contribution received with other works known to him, he is required to report them immediately to the Editorial board.
    25. Confidentiality. The referees may not in any way disseminate the articles received or discuss on them with people not authorized by the Editorial board. The content of the papers and the confidential information obtained during the review procedure must not be used by the referees for their own scientific or personal benefit.
